Insurance Disputes –

Typically insurance disputes involve life, auto, home owner, or Personal Injury Protection (PIP) insurance. Insurance companies and their policies can be confusing, and the agents can be intimidating to someone without knowledge of the industry. Usually the insurance company will either deny the claim altogether, or offer an amount that is not sufficient to cover the loss the policy holder has experienced. If you do not fully understand the time table and steps required by your insurance company, you may be limiting your options.

For example, Florida's no-fault insurance law underwent changes originally intended to assist Florida consumers in keeping their premium prices low; however, the changes that were made can also severely limit your right to obtain the benefits which you have already paid for. The law now requires drivers to carry active auto insurance with PIP coverage so medical treatment of injuries suffered in a car accident can be covered by their own insurance company, regardless of which party is at fault. This treatment now needs to be obtained from a licensed and approved provider within 14 days following the accident. Without following the requirements of the law, you may not be entitled to coverage despite paying your premiums.

The state of Florida Wrongful Death Act states, “When the death of a person is caused by the wrongful act, negligence, default, or breach of contract or warranty of any person… and the event would have entitled the person injured to maintain an action and recover damages if death had not ensued, the person… that would have been liable in damages if death had not ensued shall be liable for damages as specified in this act...”

Losing a loved one is never easy, and losing someone suddenly as the result of a tragic event is one of the hardest things a partner or family member will experience. The resulting loss can be economic: medical bills and funeral expenses are forwarded to those left behind, and future wages that would have gone to pay the bills will not be forthcoming. There are also non-economic losses: a wife or husband will never see their spouse; a child will never have their parent’s guidance.

The pain and suffering, guilt, grief and mental anguish experienced by those left alive is incalculable and would never have existed if it weren’t for someone's unreasonable act, careless behavior or negligence. There were 338,633 drivers involved in these accidents, and, unfortunately, 2,563 people were killed (in 2,372 accidents involving fatalities) and 197,214 were injured (in 125,675 in accidents involving injuries). With those statistics, auto accidents may be the most common way a person experiences a severe injury.
